Justice Anwar Zahir Jamali, presiding over a two-member bench hearing the missing persons case, remarked freedom of any citizen could not be curbed beyond the law and Constitution and if someone’s freedom had to be suppressed, the legal avenue would have to be pursued.
The court was told during the hearing of missing person Mudassar Iqbal’s case that SP Lahore Shahzad Nadim Bokhari, who had requested for including the UNHCR representative in the investigation of the case, had been transferred to the FIA, and therefore, the process of the investigation had stalled.
The UNHCR representative had sent a report to the police that the UN official working for the recovery of missing persons had spotted the missing person Mudassar Iqbal in the custody of intelligence agencies. Efforts were made to contact the the representative but he declined
oblige, upon which court had issued a notice to him.
Additional Advocate General (AAG) presented this report before the SC. The court directed the SP to contact the UNHCR representative within two weeks and present a report before it.
Justice Azmat remarked, “Missing persons cases are of highly serious nature. The government will have to do something in this connection.”
At the inception of hearing, the police presented a report before the court. The petition of Karam Elahi was also heard.
AAG Tariq Khokhar told the court the investigation into the case was assigned to sessions judge Chakwal. He is on leave and the report can come after Eidul Fitr, he said.
The hearing of Omar Zada and Omar Bakht case was adjourned for two weeks. When mother of a missing person burst into tears saying, “Where should we go?”, Justice Azmat remarked: “We are working beyond what the law allows us.”
Amna Masood Janjua said Gul Faqir had gone missing from Mohmand Agency and he is in detention center now.
The court directed AAG to see the list of the persons who are kept in detention center. It will be decided after obtaining the information where Gul Faqir is, it said. During the course of proceeding, Amna Janjua apprised to the court that Ghulam sajjad was detained in Qasim Bela Cantt Multan a detention center.
She apprehended that there may be more missing persons detained in that detention center, she requested the apex court to issue orders for the release of Ghullam Sajjad.While seeking one week time to file a reply, the additional advocate general Punjab said that he has to seek instructions from the concerned authorities.The bench directed the additional advocate general Punjab that the report should be based on facts, otherwise the law would take its course.The case was adjourned for a week.
